Terms of use

Last updated: October 2026

Please read these terms carefully before using Send Emoji. By using the app, you agree to them.

Acceptance of terms

These Terms of Service ("Terms") are a legal agreement between you and LINBETTA Ltd, a company registered in England and Wales, trading as Send Emoji ("Send Emoji", "we", "us", "our").

By downloading, installing, or using the Send Emoji application or any related services (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Service.

These Terms apply alongside our Privacy Policy, which explains how we collect and use your information.

Description of service

Send Emoji is a daily wellness check-in application. It lets you send a simple emoji to nominated contacts (your "Monitors") to signal that you are okay. If a check-in is missed within a time window you configure, your Monitors can receive an alert.

The Service includes:

We may update, improve, or discontinue features of the Service at any time. Where a significant change affects your use of the Service, we will give you reasonable notice.

User accounts and eligibility

To use Send Emoji, you must:

You are responsible for all activity that takes place under your account. We are not liable for any loss arising from your failure to keep your credentials secure.

You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable use

Send Emoji is designed to give people peace of mind. Please use it responsibly. You agree not to:

We reserve the right to suspend or terminate accounts that misuse the Service, without prior notice where necessary to protect other users or third parties.

Subscriptions and payments

Checking in with Send Emoji is always free. Looking out for someone requires a paid subscription plan. Every plan starts with a one-month free trial, as described in the app at the time of purchase. SOS alerts are always delivered to the people looking out for you, whether or not they have a plan.

All subscription purchases and billing are managed through the Apple App Store or Google Play Store, depending on your device. By subscribing, you agree to the payment terms of whichever store you use. We do not hold or process payment card information directly.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. The renewal charge will be the current subscription price at the time of renewal.

Refunds: Because payments are processed by Apple or Google, refund requests must be made directly through the relevant store. We are unable to issue refunds directly, except where required by applicable law (including your statutory rights as a UK consumer).

Prices are shown in pounds sterling (GBP) and include VAT where applicable. We reserve the right to change subscription prices with reasonable notice; price changes will not affect active billing periods already paid for.

Cancellation

You may cancel your subscription at any time through the App Store or Google Play subscription management settings on your device.

Cancelling stops the next renewal charge. You will retain access to your paid features until the end of the current billing period you have already paid for. After that, check-ins and missed check-in alerts are paused for you until you choose a plan again. SOS alerts continue to be delivered.

Cancellation does not entitle you to a refund for the current billing period, except where required by law.

If you wish to delete your account entirely, you can do so from within the app settings. Account deletion removes your personal data in accordance with our Privacy Policy.

Disclaimer of warranties

In an emergency, always call your local emergency number (for example 999 in the UK, 911 in the US or 112 in Europe). Send Emoji is not a substitute for emergency services and must never be treated as one.

Send Emoji is a personal check-in tool. It is not a medical device, a crisis line, or a substitute for professional health or care services. It is not designed or approved for use in medical, clinical, or high-risk environments.

While we work hard to keep Send Emoji reliable, we cannot guarantee that:

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties, conditions, and representations relating to the Service.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

Limitation of liability

To the fullest extent permitted by applicable law, LINBETTA Ltd will not be liable for:

Our total liability to you in connection with the Service will not exceed the amount you paid to us in the 12 months before the claim arose, or £50, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot lawfully be excluded.

Changes to terms

We may update these Terms from time to time. When we make a material change, we will notify you in the app and update the "Last updated" date at the top of this page.

Your continued use of the Service after a change is published means you accept the updated Terms. If you do not accept a change, you should stop using the Service and cancel any subscription before the new Terms take effect.

Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer based in another part of the UK or in the EU, you may also have rights under the laws of your own country that we cannot exclude.
